DeSantis declares Florida WILL NOT COMPLY with new Biden rule forcing schools to recognize LGBTQ-identifying students

Florida Gov. Ron DeSantis has declared that the Sunshine State will not comply with the White House's new rules that provide protections to LGBTQ-identifying students in schools.

In April, the administration of President Joe Biden finalized the enforcement of new Title IX rules. The rule change acts on 2021 guidance from the Department of Education, expanding the definition of discrimination in schools to include sexual orientation, gender identity and sex characteristics. The rule change is set to take effect on Aug. 1.

The guidance is a reversal of a policy set during the administration of former President Donald Trump, which itself is a rule change from those enforced during former President Barack Obama's term that directs schools to allow transgender-identifying students to use school facilities that align with their chosen gender identities.

But DeSantis has taken a firm stance against the new rule. In a letter from Florida Education Commissioner Manny Diaz Jr. to superintendents, DeSantis declared that no educational institution in Florida should begin implementing any changes as mandated by the federal government.

"Instead of implementing Congress' clear directive to prevent discrimination based on biological sex, the Biden administration maims the statute beyond recognition in an attempt to gaslight the country into believing that biological sex no longer has any meaning. In doing so, it seeks to commandeer Florida's educational institutions and force them to violate various federal and state laws, including the First Amendment and Florida's Parental Rights in Education Act, as well as statutes to protect students' privacy in bathrooms and locker rooms," Diaz wrote.

"In Florida, we respect parents' rights to direct their children’s education. We protect our students’ safety and privacy. And we make sure every student is given the chance to thrive on and off campus. We will keep pressing to accomplish these goals." Furthermore, Florida Attorney General Ashley Moody has announced plans to challenge the new rule in court.

"Biden's new Title IX rules shred protections for women – that so many fought for over decades. The idea that young girls can now legally be forced to undress in the same room with males in what is supposed to be a safe space like a locker room, that a young woman could be randomly assigned a roommate that is a biological male with little-to-no-say over the matter, or that biological men would be eligible for women's scholarships is ludicrous. We absolutely plan to challenge this betrayal of women in court," Moody wrote on X.

Other Republican-led states ignoring Biden rule change

At least six other states led by Republicans have expressed their opposition to Biden's Title IX rule change, some of which have already filed lawsuits to prevent the rule change from coming into effect.

In Texas, Attorney General Ken Paxton immediately sued the Biden administration in an attempt to block the implementation of the new Title IX rules. In a statement, Paxton said the new rules mandate "compliance with radical gender ideology."

The Republican attorneys general of Idaho, Louisiana, Mississippi and Montana filed a separate lawsuit against the Title IX changes, arguing that they exceed the Education Department's authority in part because the rule change redefines the legal definition of sex to include gender identity.

"This is all for a political agenda, ignoring significant safety concerns for young women students in pre-schools, elementary schools, middle schools, high schools, colleges and universities across Louisiana and the entire country," said Louisiana Attorney General Liz Murrill in a statement.

In Oklahoma, State Superintendent of Public Instruction Ryan Walters said that the state is "pursuing all actions to oppose this illegal and unconstitutional move by the Biden administration."

All aforementioned states have also pushed through with instructing respective officers and agencies to not comply with the rule change.
